What are the penalties for DUI?

In Alaska, DUI and refusal charges can be prosecuted as misdemeanors or felonies depending upon the defendant's criminal record. For defendants with no prior convictions, first and second offenses are misdemeanors.

For defendants with two or more prior convictions for DUI or refusal, a third DUI or refusal may be a felony (depending on when the prior offenses occurred), and tried in superior court by a jury of twelve.

First Offense (misdemeanor)

  • 90 day license revocation

Second Offense (misdemeanor)

If a third DUI offense is prosecuted as a felony, it is punishable by 240 days minimum jail time, a $10,000 fine, the installation of an ignition interlock device for 60 months, and a lifetime license revocation.
