What are the penalties for DUI?

In Alaska, DUI and refusal charges can be prosecuted as misdemeanors or felonies depending upon the defendant's criminal record. For defendants with no prior convictions, first and second offenses are misdemeanors.

For defendants with two or more prior convictions for DUI or refusal, a third DUI or refusal may be a felony (depending on when the prior offenses occurred), and tried in superior court by a jury of twelve.

First Offense (misdemeanor)

  • 72 consecutive hours in jail
  • Minimum $1,500 fine
  • Ignition interlock device (6 months)
  • Cost of imprisonment ($330)
  • 90 day license revocation

Second Offense (misdemeanor)

  • 20 days minimum jail time
  • $3,000 minimum fine
  • Ignition interlock device (12 months)
  • Cost of imprisonment ($1,467)
  • 1 year license revocation

Third Offense (misdemeanor)

  • 60 days minimum jail time
  • $4,000 minimum fine
  • Ignition interlock device (18 months)
  • Cost of imprisonment ($2,000)
  • 3 year license revocation

If a third DUI offense is prosecuted as a felony, it is punishable by 240 days minimum jail time, a $10,000 fine, the installation of an ignition interlock device for 60 months, and a lifetime license revocation.
